OFFICIAL RULES, JOB DESCRIPTION AND APPLICATION PROCESS
Please read these Official Rules completely before applying for “America’s Best Summer Job” (the “Position”). By applying for or accepting the Position, applicants represent that they are a US citizen eligible for employment in the United States and its territories, and have read and agree to be bound by these Official Rules and Regulations.
SUBMISSION OF AN APPLICATION FOR AMERICA’S BEST SUMMER JOB CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES. THESE RULES FORM A BINDING LEGAL AGREEMENT WITH RESPECT TO AMERICA’S BEST SUMMER JOB.
“America’s Best Summer Job” Description
Malen Yantis Public Relations, in connection with the Vail Local Marketing District Advisory Council (“VLMDAC”), is seeking a summer contractor willing to move to Vail, Colorado for the Summer of 2014 to experience all that the Summer in Vail, Colorado has to offer. America’s Best Summer Job is an experiential job that will give the right candidate insight into all aspects of summer tourism in Vail. In addition to the real-life marketing experience the intern will gain as an ambassador of the Vail Valley, the experience promises to be transformational because the intern will engage in a variety of activities and programs that promote the Vail lifestyle.
The right candidate must have a spirit for adventure while understanding important communications principles. Strong writing and social media skills are important. To be eligible for this Position, you must be twenty-one (21) years of age or older on or before June 2, 2014.
What We Are Looking for in Candidates:
• An outgoing spirit and excitement to learn and explore.
• Strong communication skills.
• Good interpersonal skills and ability to work effectively in a team environment
• Proficiency in Microsoft Suite Office.
• An ability to prioritize time-sensitive assignments.
• Creativity and flexibility.
• Familiarity with social media sites (with additional training to be provided).
Weekly Job Requirements are likely to include:
o Hosting a weekly meetup at host lodging properties
o Making two-three blog postings and photo postings per week
o Making one vblog post per week
o Appearing a weekly basis on TV8 and local radio station(s)
o Posting a minimum three Tweets per day
o Posting weekly Facebook messages and statuses
o Uploading ongoing Instagram posts
o Sponsoring monthly online “Intern Chats”
o Leading weekly bicycle cruiser tours of Vail
o Leading weekly walking tours of Vail
o Taking multiple local hikes per week, and posting about “hikes of the week”
o Working one morning a week at the Vail Welcome Center
The final list of job duties will be determined on or before in the final selection process and the selected applicant will be required to sign a contract stating they are willing and able to perform all of the specific duties of America’s Best Summer Job. Once an applicant is selected for America’s Best Summer Job, the applicant shall agree and consent to the use of their names, voices, statements, photographs, likenesses, Content and other personal information by Malen Yantis Public Relations, VLMDAC, Vail Resorts, Inc. and their advertising and promotion agencies for advertising and publicity purposes worldwide and in perpetuity in any and all forms of media now known or hereafter devised, including without limitation online and in social media, without approval or compensation.
• The Position begins on June 2, 2014 and ends on August 10, 2014.
• The selected applicant will be required to work Wednesday through Sunday with Mondays and Tuesdays off.
• The selected applicant will receive a $1,000/week stipend for a total of $10,000 for the summer.
• All lodging is included throughout the Summer. Each week the The selected applicant will reside at a different lodging property throughout Vail Valley – most of which are four- or five-star properties.
• Transportation to and from Vail will be covered (airfare or mileage reimbursement).
THE APPLICATION PROCESS
• Application forms available at blog.vail.com/americas-best-summer-job and must be submitted via blog.vail.com/americas-best-summer-job on or before March 15, 2014.
• Applicants must submit a 60-90 second original video describing why they should be selected for America’s Best Summer Job by March 31, 2014. We are looking for applicants with the enthusiasm and skills act as an ambassador of the Vail Valley and all that Summer in Vail, Colorado has to offer. Any video camera should be fine – we are more interested in seeing an applicant’s passion and hearing what an applicant has to say. This is an opportunity to show off your creative skills and enthusiasm.
• Online voting will take place through March 31, 2014. The top vote-getters will be selected via online voting. Malen Yantis Public Relations and VLMDAC reserve the right to select the top 10 applicants based on all criteria, including votes received and qualifications.
• A review panel will select the final candidate by April 30, 2014.
Applicants shall be required to submit or transmit audio, video, text, or other materials (collectively, “User Submissions”). Video content should be informative, educational and entertaining, as well as original. Entries that are lewd, obscene, pornographic, disparaging or otherwise contain objectionable material may be disqualified at the sole discretion of Malen Yantis Public Relations and VLMDAC.
When you provide User Submissions, you grant to Malen Yantis Public Relations and VLMDAC, their affiliates, and partners a non-exclusive, worldwide, royalty-free, fully sublicenseable license to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce, make available, transmit, broadcast, sell, translate, and create derivative works of those User Submissions, and your name, voice, likeness and other identifying information where part of a User Submission, in any form, media, software, or technology of any kind now known or developed in the future, including, without limitation, for developing, manufacturing, and marketing products. You hereby waive any moral rights you may have in your User Submissions.
We respect your ownership of User Submissions. If you owned a User Submission before providing it to us, you will continue owning it after providing it to us, subject to any rights granted in the Terms and any access granted to others. If you delete a User Submission, our general license to that User Submission will end after a reasonable period of time required for the deletion to take full effect. However, the User Submission may still exist in our backup copies, which are not publicly available. If your User Submission is shared with third parties, those third parties may have retained copies of your User Submissions. In addition, if we made use of your User Submission before you deleted it, we will continue to have the right to make, duplicate, redistribute, and sublicense those pre-existing uses, even after you delete the User Submission.
We may refuse or remove a User Submission without notice to you. However, we have no obligation to monitor User Submissions, and you agree that neither Malen Yantis Public Relations and VLMDAC, their affiliates, and partners, contractors, or agents will be liable for User Submissions or any loss or damage resulting from User Submissions.
We do not guarantee that User Submissions will be private, even if the User Submission is in a password-protected area. Accordingly, you should not provide User Submissions that you want protected from others.
You represent and warrant that you have all rights necessary to grant to Malen Yantis Public Relations and VLMDAC the license above and that none of your User Submissions are defamatory, violate any rights of third parties (including intellectual property rights or rights of publicity or privacy), or violate applicable law.
By applying for America’s Best Summer Job you fully and unconditionally accept and agree to be bound by these Official Rules and the decisions of Malen Yantis Public Relations and VLMDAC, which shall be final. By applying, you also agree to waive any right to claim ambiguity or error in these Official Rules or in the Contest. Malen Yantis Public Relations and VLMDAC are not responsible for incorrect or inaccurate transcription of application information, for problems related to any of the equipment or programming contractor with or utilized in the application, for any technical or human error which may occur in the processing of applications, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access any Web site or on-line service, for any other technical or non-technical error or malfunction or entries not received by the specified deadline for whatever reason. Illegible or incomplete applications will be disqualified.
By applying for America’s Best Summer Job, applicants agree and consent to the use of their names, voices, statements, photographs, likenesses, Content and other personal information by Malen Yantis Public Relations and VLMDAC and their advertising and promotion agencies for advertising and publicity purposes worldwide and in perpetuity in any and all forms of media now known or hereafter devised, including without limitation online and in social media, without approval or compensation. By participating, applicants grant Malen Yantis Public Relations and VLMDAC and their advertising and promotion agencies the right to use and publish their names and place of residence on-line and in print, or any other media, worldwide and in perpetuity, in connection with this Position.
Release, Assumption of Risk.
Each applicant agrees to ASSUME ALL RISKS contractor with application for America’s Best Summer Job, and agrees to hold harmless, release, defend and indemnify Malen Yantis Public Relations and VLMDAC and their affiliates, contractors and agents, representatives, assignees, directors, officers, partners and shareholders (each hereinafter a “Released Party”) from all liabilities, litigation and/or claims for injury or death to persons or damage to property arising from application for America’s Best Summer Job, including those injuries and damages caused by a party’s alleged or actual: 1) negligence or 2) breach of any express or implied warranty.
Applicants agree that personal information submitted in applications for America’s Best Summer Job, including name, mailing address, phone number, and email addresses may be collected, processed, stored and used by Malen Yantis Public Relations and VLMDAC their affiliates or agents for the purposes of conducting and administering the application process for the Position. By applying for the Position, applicants agree to the transmission, processing, use, disclosure, and storage of this personal data.
Right to Cancel.
Malen Yantis Public Relations and VLMDAC and their affiliates reserve the right to cancel or modify America’s Best Summer Job, and the application process, at their sole discretion. The Position and application process may be canceled if, by way of example, fraud, misconduct or technical failures harm the integrity of the application process, or if a computer virus, bug, or other technical problem corrupts the administration or security of the application process. In the event of termination, a notice will be posted online. If insufficient applications are received, or if no applicants meet the requirements of the Position, the position may be canceled.
Arbitration; Choice of Law.
Except where prohibited, applicants agree that (1): any and all disputes, claims, and causes of action arising out of or connected with the application process are exclusively by arbitration pursuant to the J.A.M.S. Rules of Arbitration, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with applying for the Position but in no event attorneys’ fees; and (3) under no circumstances will applicants be permitted to obtain awards for and applicant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. In consideration of applying for America’s Best Summer Job, ALL APPLICANTS AGREE that ANY AND ALL CLAIMS for damages and injury, including but not limited to all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be GOVERNED BY COLORADO LAW and EXCLUSIVE JURISDICTION shall be in the state or federal courts located in the State of Colorado.
